Rep. Dan Bishop Joins Bicameral Amicus Brief In Support of Former President Trump's Appeal of Colorado Ballot Decision

Washington, D.C. - Rep. Dan Bishop, along with numerous Republican lawmakers, has joined an amicus brief in support of former President Donald Trump's appeal of the Colorado Supreme Court's decision to remove him from the state's presidential ballot. The amicus brief argues that the Colorado Supreme Court's ruling undermines the prerogatives of Congress and sets a dangerous precedent for future elections.

In the case of Trump v. Anderson, the U.S. Supreme Court is considering whether Trump should remain on the ballot in Colorado, where he is the current frontrunner for the Republican Party's presidential nomination. The Colorado Supreme Court had ruled that Trump should be removed from the ballot, prompting this appeal.

Rep. Bishop and his colleagues contend that the Colorado Supreme Court's decision infringes on the power of Congress to control the enforcement and removal of a president from office. They argue that the court's interpretation of "engage in insurrection" is overly broad and can be easily abused to target political opponents. The lawmakers are urging the U.S. Supreme Court to reverse the Colorado Supreme Court's ruling.

Speaking about the amicus brief, Rep. Bishop stated, "The absurd decision from the Colorado Supreme Court that state officials can impede free and fair elections by subjectively blocking candidates from the ballot cannot stand. This is a frightening example of how far the radical left will go to discredit President Trump - to the point of running roughshod over the rule of law and our Constitution. I'm looking forward to the Supreme Court reversing this disturbing ruling, and I'm proud to work with my colleagues on this critical amicus brief."

House Majority Leader Steve Scalise and Senator Ted Cruz also expressed their support for the amicus brief. Leader Scalise emphasized that the Colorado Supreme Court's ruling undermines the democratic process and sets a dangerous precedent. He stated, "Not only does the Colorado Supreme Court have no authority to remove President Trump from the ballot in the 2024 presidential election, but the broad and ill-defined justifications they use can easily be abused in the future to block political opponents from assuming office."

Senator Cruz echoed these concerns, saying, "While President Biden and his allies claim they are defending democracy, their supporters are working to undermine democracy by banning Biden's likely general election opponent from appearing on the ballot. The American people see through this, and I'm confident the Supreme Court will as well."

Support for the amicus brief extends beyond lawmakers to America First Legal, an organization dedicated to defending the Constitution and the rule of law. America First Legal Vice President and General Counsel Gene Hamilton emphasized the importance of the brief, stating, "The Colorado Supreme Court's decision threatens the very legal fabric that binds our constitutional republic together, and it cannot stand."

The amicus brief, submitted by America First Legal and Boyden Gray, represents the collective effort of 179 members of Congress who are standing up for the integrity of the electoral process and the rights of the American people.
